Unexamined Patent
"There are two systems in patent application protection, examined and unexamined. In the examined patent system, a review report is prepared after the search report. In the unexamined patent system , only when the search report is prepared, the examination report is not prepared. In addition, the examined patent provides 20 years of protection to the inventor. The unexamined patent protection period is 7 years. "
If the system preference is not made within 3 months after the notification of the search report, it is accepted that the unexamined patent granting system is preferred and the "unexamined system preference" is published.
The application is made 18 months after the date of publication. The applicant may request the application to be published before the end of 18 months. In case of an early publication request, the application is published after the research request is made. The application and the research report are published together.
Third parties can submit their opinions to the research report within 6 months after the research report is published. Oppositions can be submitted within 3 months.
If the applicant does not provides an observation within 3 months, the Institute decides to grant an unexamined patent.
